Global Privacy Control

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to the websites you visit to opt out from certain types of data processing, including data “sales” and “sharing” as defined under applicable privacy laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Websites. Any transmission of personal information is at your own risk.

If you are a California resident, please note that we only use or disclose your Sensitive Personal Information as allowed by the California Consumer Privacy Act and we do not collect or process Sensitive Personal Information with the purpose of inferring any characteristics about California residents.

Automated Decision Making Technologies

Automated decision-making technologies (“ADMT”) are technologies that process Personal Information and use computation to execute a decision and either replace or substantially replace human decision-making, resulting in decisions made without human involvement. Decisions are significant when they result in the provision or denial of employment or independent contracting opportunities or compensation, education enrollment or opportunities, housing, healthcare services, or financial or lending services. Advertising is not a significant decision. We do not currently use ADMT to make significant decisions about applicants or consumers, so we do not provide ADMT access, opt-out, or appeal rights.

Exercising Your Rights

To exercise these rights, you generally must submit a request and verify your identity to a degree of certainty based on the sensitivity of your request. As required by applicable law, we will seek to verify your identity and state of residence for each request (a “Verifiable Consumer Request”). We will not fulfill your request unless you have provided sufficient information for us to reasonably verify your identity as the consumer about whom we collected Personal Information. To submit your Verifiable Consumer Request, email us at privacy@happyinnovations.com with the subject line “Verifiable Consumer Request.”

Only you, or someone legally authorized to act on your behalf (an “Authorized Agent”), may make a request to know, delete, correct, or otherwise exercise rights related to your Personal Information. We require Authorized Agents to provide written authorization confirming they may submit a request on your behalf, and we may require you to verify your own identity directly with us. We endeavor to substantively respond to a Verifiable Consumer Request within forty-five (45) days of receipt. If we require an extension, we will inform you of the reason and the extension period, as permitted by applicable law.

Once we receive your request and confirm your identity, we will review your request. We may deny your request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies. If we deny your request, you may submit an appeal. Instructions for how to submit your appeal will be included in our response explaining why we denied your request.

Your Privacy Choices – Opt Out Right

The California Consumer Privacy Act provides California residents with the right to opt-out of the ‘sharing’ of personal information for cross-context behavioral advertising. When you exercise this right, we will not disclose your Personal Information for these purposes. To opt out of the sharing of your personal information for these purposes, please use our webform here: Happy Nuts | Happy Curves.

Non-Discrimination

We will not discriminate against you for exercising any of your data subject rights. We do not charge a fee to process or respond to your Verifiable Consumer Request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Notice of Financial Incentive

We may offer various incentives to consumers who choose to share their Personal Information with us, such as their email address or phone number, or who choose to enroll in our loyalty, rewards, referral, or subscription programs. These incentives may include but are not limited to discounts on our products, points, rewards, free shipping, early access, or other financial benefits. Participation in these programs is entirely voluntary and is governed by the terms and conditions of such program and by our Terms of Use. You must opt-in to participate in such programs, and you have the right to withdraw from such program at any time by exercising your rights as described above. We calculate the value of the Personal Information provided in connection with these programs using a good-faith estimate of the costs and expenses we incur in offering the applicable incentive, and that value is reasonably related to the value of the offer, discount, or benefit provided to you.

California’s Shine the Light Law

California Civil Code Section 1798.83 permits users of our Websites that are California residents to request certain information regarding our disclosure of the information you provide through the websites to third parties for their direct marketing purposes. To make such a request, please contact us at the information provided below.

International Data Transfers

Our products are directed to residents of the United States and are intended for use in the United States. To the extent we accept orders from consumers located in the European Union, we do so from the United States, and any Personal Information collected through the EU Withdrawal Button will be transferred to and processed in the United States.

EU Withdrawal Button

If you are a consumer located in the European Union, you may exercise your statutory 14-day right of withdrawal from a purchase by using the "Withdraw from Contract here" button available in the footer of each of the Websites. When you use the button, we collect the information you enter into the withdrawal form, including your name, the order or contract identifier (such as your order number), the electronic contact details you provide for our confirmation of receipt (such as your email address and, where offered, phone number), and, where your order comprises multiple products, the product(s) to which your withdrawal relates. We also record the date and time your withdrawal declaration is received. We use this information to acknowledge and process your withdrawal declaration, issue the confirmation of receipt required by applicable law, and administer the return of the goods and the reimbursement of the purchase price in accordance with our usual returns process. We share this information with our customer-service and returns personnel, with Shopify (which hosts the Websites and the withdrawal form), with the payment processor originally used for your transaction (for purposes of issuing your refund), and with the transactional email or SMS provider used to deliver the confirmation of receipt to you. We do not use information submitted through the withdrawal button for advertising, and we do not share it with advertising networks, social networks, or other AdTech partners.
